It does apply when a commercial or multi-family developer removes trees for a construction project, and when a business removes a tree from commercially zoned property. Substitute Ordinance BL2022-1409 has been in effect since 15 March 2023 and it set the terms. A general standard of twenty-two Tree Density Units per acre. Protected trees start at six inches DBH, with separate heritage and historic classes worth more. Sites over five thousand square feet need a tree inventory map from a licensed professional, a landscape plan showing protection zones, and a disposal plan. Signage on the property at least seven days before work begins.

The penalties have teeth: fifty dollars per violation per day for starting before the permit issues, replacement at two caliper inches for every inch removed or forty-four TDU per acre disturbed, whichever is greater, and a three-year survival requirement on the replanting.
